General Terms and Conditions of Sale (GTC)

 

 

1. Purpose and Scope

 

These General Terms and Conditions of Sale (GTC) apply to all orders placed on the website alice-miller.com, hereinafter referred to as "the Site". They govern the contractual relationship between Brigitte Oriol, hereinafter "the Seller", and any buyer, whether a natural or legal person, hereinafter "the Client".

Any order placed on the Site implies the unreserved acceptance of these GTC, which the Client acknowledges having read before validating their purchase.

 

2. Product Characteristics

 

The products offered for sale are original and unique works of art created by Alice Miller. They are presented on the Site with a detailed description and non-contractual photographs. As the artworks are unique, slight variations may exist compared to the photographs.

Each artwork is sold as presented on the Site, with no possibility of modification.

 

3. Price

 

Prices for artworks are in the selected currency and include all taxes (VAT). They include shipping costs.

The Seller reserves the right to change prices at any time, but the artworks will be invoiced based on the rates in effect at the time the Client validates the order.

 

4. Ordering

 

The Client who wishes to place an order must follow these steps:

  1. Select the artwork of their choice and add it to the cart.

  2. Check the contents of their cart and the order summary (price, delivery costs, etc.).

  3. Provide the necessary information for billing and delivery.

  4. Choose the payment method and validate their order.

The validation of the order by the Client constitutes acceptance of the offer and the GTC. The Seller will send a confirmation email summarizing the order.

 

5. Payment

 

Payment is made online by credit card (Visa, MasterCard, American Express). The Seller has implemented a secure payment system to guarantee the confidentiality of banking data.

Payment is considered validated upon receipt of the payment authorization from the banking institution.

 

6. Delivery and Shipping

 

The artworks are shipped from France. The Seller agrees to ship orders within 5 business days from the payment validation.

Shipping costs are the responsibility of the Seller. A tracking number will be provided by email so that the Customer can track the progress of their order.

The announced delivery times are estimates and may vary. The Seller cannot be held responsible for delivery delays attributable to the carrier.

 

7. Right of Withdrawal and Returns

 

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for the supply of goods made to the consumer's specifications or clearly personalized. The original artworks sold on the Site are considered unique and personalized goods.

Consequently, the right of withdrawal is not applicable, and purchased artworks cannot be exchanged or refunded.

 

8. Liability

 

The Seller cannot be held liable for damages resulting from the Client's misuse of the artwork.

The Seller's liability cannot be engaged in case of delay or failure to fulfill contractual obligations due to a force majeure event as defined by the French Civil Code.

 

9. Intellectual Property

 

Any reproduction, representation, use, or modification, by any process whatsoever, of all or part of the artworks without the Seller's prior written consent is strictly prohibited.

The acquisition of an artwork does not grant the Client any right of reproduction or representation.

 

10. Governing Law and Disputes

 

These GTC are subject to French law.

In the event of a dispute, the parties will endeavor to find an amicable solution. Failing this, any dispute relating to the conclusion, execution, or interpretation of these GTC will be submitted to the competent courts of France.
